Terms of Service

These terms ("Terms") govern your use of the website at wingscontractors.com ("the Site") and any engagement of construction or related services from Wings Contractors Ltd ("we", "us", "Wings Contractors"). By using the Site or engaging our services you agree to these Terms.

1. About us

Wings Contractors Ltd is a Kenyan building and construction company registered in Kiambu County, with operations across the country. We deliver residential, commercial, civil, interior, exterior, precast, renovation, supervision, and landscaping services.

2. Use of the website

The Site is provided for informational and enquiry purposes. You may browse, share, and link to pages freely. You may not:

• Use the Site to harm others, distribute malware, or scrape at scale.
• Copy substantial site content, photos, or project case studies into competing material without written permission.
• Attempt to reverse-engineer, probe, or attack the underlying infrastructure.

3. Project quotes and proposals

Any quote, estimate, or written proposal we provide is an offer, not a contract, and remains valid for 30 days from the date issued unless stated otherwise. A binding agreement only exists once we have a signed contract or written project order from you, together with any deposit specified in that document.

4. Engagement & payment

• Scope. The scope of work, materials, timeline and payment schedule will be set out in your individual project contract.
• Variations. Any changes to agreed scope must be in writing (email or signed variation order) and may affect cost and timeline.
• Payment. Standard payment terms are staged against project milestones, with final payment due on practical completion. Late payments accrue interest as set out in the contract.
• Taxes. All amounts are exclusive of VAT unless stated. VAT, where applicable, is charged at the prevailing KRA rate.

5. Workmanship & warranty

We warrant that work is performed to good industry standards by competent personnel using fit-for-purpose materials. Defects in our workmanship reported within 12 months of practical completion will be remedied at no cost. The warranty excludes:

• Damage arising from misuse, neglect or third-party modification.
• Normal wear and tear.
• Materials supplied by you or by third parties outside our control.
• Damage from extreme weather events, vandalism or other force majeure.

6. Site access & safety

You agree to provide safe and lawful access to the project site, including utilities (water, power) where reasonably needed, and to inform us of any known hazards. We comply with applicable health and safety standards and maintain valid insurance for workers and public liability.

7. Intellectual property

Site content, photography, designs, and case studies are owned by Wings Contractors Ltd or licensed to us. You may share links to the Site but may not republish substantial content elsewhere without written permission. Designs prepared as part of a project remain our intellectual property until full payment is received, at which point you receive a non-exclusive licence to use them for the agreed project.

8. Limitation of liability

To the maximum extent permitted by Kenyan law, our total liability arising out of or in connection with any engagement is limited to the fees paid by you under that engagement. We are not liable for indirect, consequential or punitive losses, including loss of profit, loss of business, or loss of opportunity. Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law.

9. Insurance & compliance

Wings Contractors Ltd holds valid public liability and workers' compensation cover and is registered with the National Construction Authority (NCA). On request we can share copies of the certificate, KRA tax compliance, and insurance schedule.

10. Cancellation

Either party may terminate an engagement in writing for material breach not remedied within 14 days of notice. On termination, you remain liable for work completed and materials ordered up to the date of termination, less any reasonable mitigation.

11. Dispute resolution

Disputes will first be raised in writing and, where possible, resolved by good-faith discussion within 30 days. Failing that, the parties agree to mediation under the rules of the Chartered Institute of Arbitrators (Kenya Branch) before commencing court proceedings. These Terms are governed by the laws of the Republic of Kenya, and the courts of Kenya have exclusive jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above will reflect the latest revision. For active contracts, the version of the Terms in force at the date of the contract continues to govern that engagement.
